Welcome to Midnight Highlights! These Terms of Service (“Terms”) govern your use of our mobile app and services (“App”). By downloading or using the App, you agree to these Terms and our Privacy Policy.

Subscription Essentials

• Price: $3.99 monthly / $29.99 annual
  
• Auto-Renewal: Subscriptions automatically renew unless canceled.
  
• Trial: A 7-day free trial is available. Payment will be charged to your Apple ID or Google account at the end of the trial unless you cancel at least 24 hours before the trial ends.
  
• How to Cancel: Manage or cancel anytime in your device’s App Store/Play Store account settings.
  
• Refunds: All refunds handled directly by Apple App Store or Google Play Store under their policies.
  
• Billing Notices: Apple/Google may send you billing or renewal emails directly.
  

1. Acceptance of Terms

By accessing or using Midnight Highlights, you accept these Terms and our Privacy Policy (available at /privacy).

2. Eligibility

• You must be at least 13 years old to use the App.
  
• The App is not intended for children under 13.
  

3. Accounts & Security

• You may create an account with your email and display name.
  
• You are responsible for keeping your account secure.
  
• If you believe your account is compromised, contact us immediately.
  

4. Subscriptions & Billing

• Subscriptions are handled through Apple App Store and Google Play Store.
  
• Subscriptions auto-renew unless canceled.
  
• Manage or cancel through your device’s account settings.
  
• Refunds are processed only under Apple or Google’s policies.
  
• Prices may change, and you will be notified by Apple or Google.
  
• Midnight Highlights does not issue refunds outside store policies.
  

5. License to Use the App

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6. Acceptable Use

You agree not to:

• Copy, scrape, or resell content from the App.
  
• Infringe our intellectual property or that of others.
  
• Use the App unlawfully or abusively.
  
• Bypass security or misuse the service.
• Use the App to generate, distribute, or train competing products or services.
  

7. Content & Intellectual Property

• All original audio, scripts, and app content are owned by Midnight Highlights LLC or its licensors.
• Midnight Highlights is an independent product and is not affiliated with, endorsed by, or sponsored by any professional or amateur sports league, team, or organization.
• References to real-world sporting events, teams, or individuals are used for descriptive, historical, and informational purposes only.
• If you send us feedback, you grant us a license to use it to improve the App.
  

8. No Medical Advice

Content is provided for relaxation, entertainment, and general wellness purposes only and is not intended to diagnose, treat, cure, or prevent any medical condition.

9. Disclaimers & Limitation of Liability

• The App is provided “AS IS.”
  
• We do not guarantee uninterrupted service.
  
• Liability is limited to the amount you paid in subscription fees during the last 12 months.
  

10. Termination

We may suspend or terminate your account if you violate these Terms.

11. Governing Law

These Terms are governed by the laws of Indiana, USA, with venue in Hamilton County, Indiana.

12. Changes to Terms

We may update these Terms. Continued use of the App means you accept the new Terms.

13. How to Make a Data Request

Requests to access, delete, or modify your personal data should be submitted as described in our Privacy Policy.
